About Mediation

The Indiana Alternative Dispute Resolution Rule 2.1 defines mediation as “the confidential process by which a neutral, acting as a mediator…, assists the litigants in reaching a mutually acceptable agreement.” The Rule explains the mediator’s role is “to assist in identifying the issues, reducing misunderstanding, clarifying priorities, exploring areas of compromise, and finding points of agreement as well as legitimate points of disagreement.” Mediation gives the parties an opportunity to dispute issues and reach a solution they can accept while avoiding the uncertainties and costs of a trial.
